Premises and acceptance of the General Conditions of Sale

The present general terms and conditions of contract (hereinafter also "General Conditions") regulate the offer by 3ND Srl (hereinafter "Vino.com") of products on www.vino.com (hereinafter also "Site"). The General Conditions must be accepted by the User at the time of registration to the Site, in order to be able to use the offers made therein and to proceed with the purchase of products.
Vino.com reserves itself the right to modify the General Conditions at any time, in whole or in part, by notifying Users through the Site with at least 30 days' notice, if the methods are changed; of use of the products and services offered. Users are therefore required to periodically consult this page, in order to be always informed about the conditions applied. It is understood that the use of the Site subsequent to such modifications implies the tacit acceptance of the same.

Ownership of the website - Type of offers

The Website is of property of the 3ND S.r.l., with registered office in Florence, Italy, 50124, Via del Tiratoio, 1, C.F. and VAT No. 06031960484, Business Register FI 594577. The name "Vino.com" is a trademark registered by 3ND S.r.l.. The products present on the Site are resold by Vino.com directly, also in the form of drop-shipping (hereinafter also "Direct Sales") or from business partners (hereinafter also "Partner") of Vino.com. Unless otherwise specified in the detail page of the property, it must be understood that the products are sold directly by Vino.com. On the other hand, in the case of a sale of products by a Partner, Vino.com offers a mere intermediary service (hereinafter also "Intermediate Sales" ) and operates in the name and on behalf of the Partner, remaining in effect extraneous to the relationship, and therefore to the sales contracts stipulated between the User and the Partner itself.
The products can be sold either through a permanent catalog, and through "flash-deal" formulas or promotions that provide for availability of products subject to quantitative and /or time limits. The offer of products is on the categories food, alcohol and accessories (wines, sparkling wines, beers, rums, grappas, other super-spirits and spirits, coffee), packaged products such as sauces, honey, canned meats and other foodstuffs and accessories for preparation, consumption or conservation of food). Following a purchase transaction, Vino.com will release to the User a confirmation of the order and the indication, in case of an Intermediate Sale, of the possible Partner that will provide to send the goods.

Registration to the Site

The Site is aimed exclusively at Users who have completed 18 years of age. The navigation and use of the services offered within the Site are made accessible after registration.
Registration is Free. Users who register with the Site will have to provide some personal data and follow all the steps from the procedure (hereinafter also "Complete Registration"). At the time of Complete registration will be requested to the User to choose a Username and a Password , that the user undertakes not to give even temporarily to third parties and to keep with due care, diligence, and secrecy under own responsibility, constituting these credentials the only means to identify the User and to validate his access to the offers. Therefore, the User is informed that all the acts carried out through the use of said credentials will be attributed to him and will have binding force towards him.
The User is asked to immediately inform Vino.com of any unauthorized or improper use of its access credentials or to report any violations by third parties. Where Vino.com findings of violations could be achieved; at its discretion inhibit the access, permanently delete the information contained therein or refuse the opening of new accounts by the same User.
At any time the User will be able to update and/or modify or request the cancellation of information released during the Registration. In case of cancellation request, however, Vino.com will temporarily maintain, in whole or in part, such information, only for the purpose of executing any purchases made and/or to be able to complete accounting and tax procedures.
Full Registration is necessary to proceed with the purchase of the products and to access the summary information related to the activities; performed by the User on the site (also " Account").
Furthermore, a partial registration is allowed on the site (hereinafter also "partial registration"), by entering only the email address of the user. The Partial Registration allows the user to receive only the newsletter, and not to proceed with the purchase of products and/or services, or in any case to carry out other operations on the Site.

Conditions of the offer

Subject of Vino.com offers the purchase of goods at the prices indicated on the Website. Vino.com reserves the right to not follow up orders from subjects other than  "consumer" in accordance with its commercial policy. In any case, Vino.com does not sell alcohol to individuals who have not completed 18 years of age. By sending the orders, the consumer guarantees that the ordering subject and, if it is different, the recipient of the goods are both over the age of 18 years.
Prices are quoted in Euros and are inclusive of VAT. The shipping costs of the goods can be fixed or variable amount, calculated based on weight, number of items selected and/or to the destination address of the goods. Shipping costs can also be included in the price of sale of some articles or be free in the event that the total amount of the order is higher at a certain value or following a specific promotion. The User is however always informed of the amount of the shipping costs first to complete the purchase procedure and make the payment .
The images accompanying the information sheets of a product or an offer may not be perfectly representative of its characteristics but differ in color, size and accessory products in the picture. All purchase support information is to be intended as a simple general information material, therefore not referable to the real characteristics of a single offer.
The validity of promotions may be subject to quantitative or temporal limitations, after which, they may not be more available. The validity date and/or the available quantity of the offers are reported on the Site in such a way as to allow the user to get to know it. Vino.com will be able to modify at any time and at its discretion the duration or quantity of an offer, notwithstanding that it will follow orders placed during the validity of a given offer. An offer may be published several times, over time, even as a result of agreements with the partner or supplier of the goods. In some cases it is possible that the availability of a good ends at a time after the purchase: in these cases Vino.com, if the conditions are met, will reimburse the User. It is also possible that for some offers of goods a specific variant is not guaranteed and will be asked to the user to specify one or more preferences at the time of purchase: under these circumstances the user is aware that it will be able to receive a different product variant from the one chosen at the time of purchase.
In the case of promotional sales or through the flash-deal formulas as specified above, the full price indicated in the offer (" Crossed-out price ") and with respect to which is calculated the discount that Vino.com applies can correspond to:
(i) to the public list price indicated by the supplier;
(ii) to the results of market surveys.
The methods of calculating the Crossed-out price vary from product to product.
Vino.com can also provide a monthly subscription service (" Subscription Service"), that is in continuous mode and following a request for activation of the service by the user and until  the user does not request deactivation. The service provides, against payment by the user of a fee indicated on the Site, the supply and relative delivery of wine and/or products selected by Vino.com at its total discretion among those provided in the catalog.

Purchase procedure and payment methods

Having acknowledged the conditions of the offer, the User will be able to complete the purchase by following the procedure on the Site.
Before the finalization of the purchase will be displayed a summary in which it will be indicated the unit cost of the selected asset and the total, in case of purchase of more, amount of the same article or different articles. The cost of any postage, delivery or postal costs may occur can be fixed or variable, calculated based on the weight of the goods, the number of items selected and/or destination address indicated by the User during the purchase process. Shipping costs can also be included in the price of sale of some articles or be free in case the total amount of the order is higher than a certain value or following a specific promotion. The User is however always informed of the amount of shipping costs before concluding the purchase procedure and making payment. Once the purchase is completed, the User will need to proceed with the payment, which will be carried out against Vino.com, both in the case of Direct Sales and in the case of Intermediate Sales. In the case of an Intermediate Sale Vino.com will receive the payment in the name and account of the Partner, therefore remaining always unrelated to the relationship between the Partner and the User. Unless otherwise specified in the detail page of the property, it must however be understood that the products are sold directly by Vino.com.
Following the successful completion of the payment, the User will receive a confirmation email containing information about the offer purchased. The email will contain in addition, a reference to these General Terms and Conditions. Confirmation will be confirmed a summary of the address delivery and billing. The shipment of the goods takes place within the time specified in the confirmation of the order. Delivery times are also indicated before concluding the purchase procedure in the shopping cart summary or on the product page. This information is indicative and does not represent a certain date, as it is not applicable; it is always possible to foresee any delays due to the courier responsible for delivery to the Customer or other causes due to third parties or force majeure not attributable to Vino.com. In case of timed offers (flash-deal), the goods could be sent to the User after the expiry of the same. In the absence of the confirmation email, the purchase will not be possible; meaning validly concluded. In this case, if the amount of the non-purchase should be wrongly charged to the User, the same will be liable to promptly notify Vino.com by sending an email to assistenza@vino75.com, in order to allow Vino.com to verify the event occurred and in case of repayment of the amount paid.
The methods of payment accepted, unless otherwise specified or agreed with the User, are: credit card and prepaid cards of the Visa circuits, Mastercard, Maestro, Postepay, American Express, Discover (Diners Club International and Pulse), with PayPal account, Apple Pay and bank transfer. Vino.com can, in some or all cases and at its sole discretion, offer the mode of alternative payment means cash on delivery (in cash upon delivery of the goods).
The payment of the sums due is done, unless otherwise specified in the terms of the offer, upon confirmation of payment. In the case of bank transfer, at the time of confirmation of the order, the bank details (IBAN) will be indicated, the amount of the bank transfer and the order number. Payment by bank transfer will be required; occur within the indicated deadlines and in any case no later than 2 days from the confirmation of the order , a term beyond which it is not possible to guarantee the evasion of the goods: in this case Vino.com provide to credit back to the sender, without additional costs and bank transfer, the payment received after the deadline.
In the case of Subscription Service, the User authorizes Vino.com to proceed to the periodic charge of the consideration on the credit card or prepaid card. In this regard, the User declares and guarantees availability; of the sum necessary to pay the fee.
If the User understands that he/she has provided incorrect and/or incomplete information regarding its general characteristics; or the shipping address of the goods, you must notify us promptly and within the time limits for ordering, by sending an email to the address assistenza@vino75.com. In all cases, the User is the sole responsible for the eventual indication of generalities; or incorrect and/or incomplete delivery address, resulting in a possibility of loss of the sum paid if the goods are delivered to strangers.

Security in transactions

Vino.com is very attentive to the safety of its Users. Vino.com does not process and does not retain payment license data (eg: credit card numbers), which are processed and/or stored by the relevant payment service providers. In fact, the actual payment takes place through fields for entering protected and encrypted payment data, served directly by the payment service (Braintree, a company of the PayPal group, Inc. More information on Braintree here and on PayPal here ). Only after the transaction has been completed, the banking service provider informs Vino.com the outcome of the payment, without providing any sensitive information. For this reason, Vino.com has no power over the possible rejection of the credit card used for payment. Vino.com can not be therefore be held responsible in any way for direct or indirect consequences deriving from the use of the credit card from the user to make the payment of the products and/or services purchased.
Navigation on Vino.com is protected and encrypted with security certificate "128/256-bit Extended Validation SSL", released by Symantec / DigiCert following a precise and constant process of verifying the authenticity of company information and ownership of the domain. It is also possible to verify the authenticity of the certificate and its titularity by clicking on the appropriate security section of the browser in use, usually next to the address bar, on the page title or on the status bar.


Vino.com can issue discount codes (hereinafter also "Coupon") that the User will be able to use at the time of purchase of the products. Vouchers are issued in the form of an alphanumeric code and their value (in euros) is established unquestionably and at its sole discretion by Vino.com. The coupon can be entered by the user in the appropriate field "Coupon" when it proceeds to the insertion of the order. The coupon entered in this way will be automatically deducted, and before payment, from the total amount of the order excluding shipping costs. Vouchers with a percentage discount are not applied to existing products in promotion. Vouchers are generally usable by the user for a limited period of time, out of which they will no longer be usable. The Coupon can be subject to a minimum amount of expense under which the use of the same will not be possible. Unless otherwise specified, the Coupon is personal and related to the User Account and can be be used for a single purchase, after which it will come automatically invalidated. Vouchers can not be combined. Vouchers can not be sold, assigned and/or transferred to third parties except with the express authorization of Vino.com. Vino.com reserves the right to cancel any previously issued Coupon, even before the deadline, without the obligation to justify the reason and without the right to indemnity or compensation. Vino.com may also issue Coupon in favor of Users who invite acquaintances, friends and family to view the website's offers and register on it. For the completion of this procedure, the Site provides some functionalities; like "Recommend to a friend", "Send email of an offer", "Share on Facebook", "Twitter", other social networks etc. For each new guest who buys an offer within a certain time period, Vino.com can recognize the User a Coupon, the value determined from time to time at the discretion of Vino.com, to be used on your Account for a subsequent purchase. Vino.com reserves the option to eliminate the Vouchers issued in favor of users who make improper use, without any prior notice and without the right to indemnity or compensation.

Shipping and delivery

Vino.com and its possible Partners accept orders with delivery exclusively on the Italian territory, including islands, with the exception of San Marino, Vatican City, Livigno and Campione d'Italia. The shipment of the goods takes place within the maximum time indicated in the conditions of the offer and, for timed offers (flash-deal), it may start from the end of the same. The shipment of the goods takes place within the time specified in the confirmation of the order. Delivery times can also be indicated before concluding the purchase procedure in the shopping cart summary or on the product page. This information is indicative and does not represent a certain date, as it is not applicable; it is always possible to foresee any delays due to the courier in charge of delivery to the Customer. In any case Vino.com, if not otherwise specified on the product sheet, it undertakes to deliver the goods within 10 working days from the date of the order and on average the goods take place in 24/48 working hours throughout Italy with the exception of the islands where the average delivery times are 48/72 working hours. In the remote case in which the goods become unavailable for any reason after receiving the order, it will be issued a refund of any payment received, without charge for the User. The User can be informed by email of the time when the product it is shipped from Vino.com , whether it be Direct Sales or Intermediate Sales, in this last case when the Partner will communicate to Vino.com the successful shipment.
Will be communicated to the User, if available, the name of the courier and the tracking number of the shipment (Waybill or "Tracking"), through which it will be possible to follow the status. This information, if available, will also be visible within the User Account.
Vino.com can not ensure that more products purchased at the same time are delivered with a single shipment, nor that any different shipments arrive at their destination at the same time. The offers, in fact, can refer to products supplied by different Partners and/or not to come from a single centralized warehouse. It is not possible to guarantee an exact delivery date or time because this depends on the courier, from the destination address and the person responsible for delivery. Vino.com can not therefore be held responsible for any direct or indirect consequence deriving from these times. The delivery of what is ordered means, unless otherwise specified during the purchase process, on the street level.
In the case of shipping bottles, Vino.com uses patented packaging and approved by the courier, designed to ensure the integrity of the product. In any case, at the time of delivery of the goods by the courier, the User will be required to verify that the packaging is intact, undamaged, or in any case altered, also in the closing materials (adhesive tape or strapping) or that there is no liquid leakage. Any damage to the packaging and/or to the product must be immediately contested by the User, by putting a written scrutiny reservation (and specifying the reason for the reservation, e.g. & quot;Pierced packaging", "Crushed packaging", etc.) on the courier delivery document. Once this document is signed, the User will not be able to advance any objection about the characteristics of what was delivered. Possible problems inherent the physical integrity, the correspondence or completeness of the products received must be reported within 3 days of delivery, by writing an email to: assistenza@vino75.com or any partner e-mail address indicated in the order confirmation and inside the User Account.
In case of non-delivery of the goods within the indicated times, the User will be required to notify it to Vino.com, which will check with the Partner and/or directly with the courier, the status of the shipment and the eventual anomaly. Following a shipping anomaly (eg parcel lost or destroyed during transport), Vino.com will carry out in case of Direct Sales or to request, in case of Direct Sales in drop shipping mode or Intermediate Sales, a new shipment of the product, compatible with availability of the same in stock or at the Partner, without additional expenses or aggravations for the user, that is, to fully reimburse the order in case of direct sale or to make sure that the Partner (directly or through Vino.com ) proceeds with reimbursement in the event of an Intermediate Sale.

Conformity guarantee of the product

Vino.com works diligently and in absolute good faith in selecting suppliers and partners, verifying the actual suitability of the same to supply the products in the quantities and according to the characteristics described in the purchase offers, being understood that Vino.com can not be responsible for damages to persons deriving from possible violation by producers. In any case, Vino.com can not guarantee completeness nor of the content of information provided by the Supplier or Partner, nor of the perfect correspondence of what is described in the product sheet or offer with the product actually delivered, as as well as the legitimacy of use by the Supplier or Partner of images, videos and distinctive signs. The User is also aware that the images used on the proposals can sometimes only be indicative of the product and not always represent faithfully the product delivered. In the case of Intermediate Sales, and therefore of products supplied directly by a Partner, these will be the sole responsible for compliance of the products under warranty. Any complaints must be sent directly to the Partner by e-mail to the address contained in the confirmation of purchase and also to assistenza@vino75.com. Partner will indicate the methods of verification, repair or replacement of the goods, or to authorize Vino.com to issue a refund in favor of the User. In the case of Direct Sales, Vino.com will be directly responsible for compliance of the products under warranty. In case of products that are not compliant, the User can contact Vino.com by sending an email to: assistenza@vino75.com . Vino.com will indicate a repair center suitable for checking and repairing the goods under warranty or, once the anomaly has been directly verified, the subsequent repair or replacement or repayment is made through re-crediting of the title originally used for payment or the issue of a coupon of equal amount of the product purchased. In any case, the legal guarantee is reserved for consumers or for those who made a purchase on Vino.com for purposes unrelated to entrepreneurial, commercial, craft or professional activity carried out.


The User who requests a service for purposes unrelated to his/her professional activity has the right to withdraw from the purchase contract concluded with Vino.com or with the Partner without any penalty and without having to provide any reasons, within 14 working days pursuant to and for the effects of the art. 52 paragraph 1 of the Consumer Code, which start from the day of receipt of the product purchased on Vino.com . The withdrawal will be possible; be exercised by the Customer, pursuant to art. 54 paragraph 1 Consumer Code, using the withdrawal form referred to Annex I, Part B of the Consumer Code or using the one available at the link: content/right-of-withdrawal or presenting any other explicit declaration of his decision to withdraw from the contract, to be sent or by delivery receipt, to 3ND Srl, Via del Tiratoio, 1 IT50124 Florence (FI) or by e-mail to the address assistenza@vino75.com or by fax to +39 055 0935599 or, in the case of Intermediate Sales, also to the e-mail address of the Partner indicated on the purchase confirmation page and also present in the User Account, also making Vino.com aware. The delivery receipt, the e-mail or fax must contain the indication of the product and of the order number. The burden of proof related to the correct exercise of the right of withdrawal, in accordance with the procedure indicated above, is: charged to the User.
Following the correct exercise of the withdrawal, unless Vino.com or the Partner does not collect the asset directly, the User will have the obligation to return the goods without undue delay and in any case within 14 days from the date on which the User has communicated to Vino.com or to the Partner his decision to withdraw from the contract pursuant to art. 54, c. 4. The User will need to apply, on the packaging, in a visible way the document received by Vino.com following the withdrawal notice mentioned above, in which they are already received; indicated the shipping address and the details relating to the order necessary to identify the return to destination. We recommend that you add a copy of that document too inside the packaging, in order to avoid the loss or the impossibility of it; to identify the return once received in the warehouse. The relative shipping costs of the goods will be charged to the User, except in the case where Vino.com has not informed the same in respect of the deed of the conclusion of the contract, in accordance with the law; to the art. 57 paragraph 1 of the Consumer Code.
The assets must in any case be kept, handled and inspected with normal care and returned intact, complete in all their parts, accompanied by all the accessories and leaflets, identification tags and original labels, if any, still attached to the goods and intact and not tampered with, as well as perfectly suitable for their intended use and free of signs of wear and tear.
As foreseen by the art. 57 paragraph 2 of the Consumer Code, the User is entitled responsible for any decrease in value resulting from manipulation of the good different from that necessary to establish the nature, characteristics and functioning of the asset itself. In this case Vino.com, upon written communication to be sent to the User within 5 working days from receipt of the goods, will reduce the amount of the reimbursement because of this decrease in value, providing it, in the event that the repayment is already been paid, the bank details for the payment of the amount due from the User due to the decrease in value of the property.
Vino.com can refuse to accept a withdrawal for food products that have even been partially consumed. Pursuant to the art. 59 of the aforementioned Consumer Code are excluded from the possibility; withdrawal of goods tailored or customized or that, by their nature, they can not be returned or are subject to rapid alteration or deterioration.

Exceptions to the right of withdrawal

In any case it is understood that, with reference to service, the right of withdrawal can not be exercised by the User after the complete supply of the products by Vino.com if the supply itself has started with the express agreement of the User and he has accepted to lose the right of withdrawal following the full execution of the service by Vino.com.
In any case, pursuant to the art. 59 of the Consumer Code, are excluded from the possibility of the withdrawal the packaged goods tailor-made or personalized or which, by their nature, can not be returned or are subject to rapid alteration or deterioration.


The possible disbursement of sums by way of reimbursement by Vino.com, if due, will happen in accordance with the art.56 paragraph 1 Consumer Code in the shortest possible time, and in any case no later than 14 days from the date on which the event that gave rise to the refund occurred and in case of withdrawal, from the day on which it is became aware of the related exercise from the User. Vino.com will reimburse using the same payment method used by the User for the initial transaction, unless expressly agreed otherwise with the User and on condition that the same does not incur any cost as a consequence of the use of the different payment methods. If the User has expressly chosen a different type of delivery that foresees higher delivery costs than those related to the standard delivery offered from Vino.com ("Supplementary Costs"), this latter will not be required to reimburse the related Supplementary Costs. It is understood that, except for the cases in which Vino.com has decided to collect the goods directly, Vino.com will retain the refund until until he has received the goods or until the User has not shown that he has returned the goods, whichever situation occurs first.

Responsibility for Vino.com

Vino.com will not be responsible for damages that may result from the use of the Site such as computer viruses, omissions, service interruptions and software failures, also to the detriment of the User's IT equipment, preventing or delaying the provision of services if these are due to external causes, force majeure and/or third parties not dependent on the will of the owner. Vino.com will be responsible only for any faults or discrepancies found in Direct Sales, while in no case will be responsible for any faults or discrepancies found in the Intermediate Sales, for which responsible towards the User will be exclusively the Partner. Consequently, the User is informed that in such situations he will have to address his own complaints and act exclusively towards the Partner. In any case Vino.com and/or the Partner can not in any case be held responsible for the delays o vices or discrepancies dependent from events beyond their reasonable control, such as, but not limited to: (i) events of force majeure; (ii) events dependent on third parties such as the interruption or malfunction of the services of telecommunications operators and/or power lines, or acts or omissions by carriers or shippers.

Industrial and intellectual properties

Notwithstanding the limitation on the use of the distinctive signs of the Partners, Vino.com is holder of all rights related to the graphic content and conceptual of the Site, as well as of the distinctive proper signs made visible in it. It is therefore prohibited the reproduction, even partial, of the content and the graphic of the Site, as well as distinctive signs made visible in the same. Vino.com is also holder of the Site management technology platform.


Personal data are collected and processed in order in order to follow up on the User's requests. Vino.com guarantees its users to operate in compliance with the law regarding the processing of personal data, governed by the Privacy Code pursuant to Legislative Decree no. 196/2003. The privacy statement is to be considered an integral part and substantial of these General Conditions and it is accessible in the Privacy section of the Site or from the link: content/privacy-policy. Conciliation procedure. Applicable law and competent Court

These General Conditions will be regulated in every respect by Italian law.
For any dispute concerning the interpretation, execution and/or termination of the contract between the User and Vino.com, in the case of Direct Sales, or between the User and the Partner in the event of an Intermediate Sale, the Parties recognize that it will be competent the judge of the place of residence or domicile of the User, if the same is considered a "consumer" according to the applicable laws in force. If instead the User is a professional, in the case of Direct Sales it will be competent the Court of Florence, while in the case of Intermediate Sales the Court of domicile of the Partner will be competent.

Alternative dispute resolution (so-called Alternative Dispute Resolution/ On Line Dispute Resolution) and Netcomm Joint Conciliation

Vino.com informs in accordance with article 141-sexies of the Consumer Code the Consumer User who, if he has submitted a complaint to Vino.com but he was not satisfied with the outcome of the same or has not received a reply within 30 days, it can start the Joint Conciliation procedure set up by the Netcomm Consortium. The User can find more information on this procedure as well as the link to the relative regulation at the address http://www.consorzionetcomm.it/Spazio_Consumatori/Conciliazione-Paritetica/Conciliazione-Paritetica.kl.
