RELEVANT INFORMATION PURSUANT TO ART. 49 OF THE CONSUMER CODE

a) What is Vino.com - 3ND S.r.l.: 3ND S.r.l. (hereinafter Vino.com) is a company with registered office in Italy, Florence, 50124, Via del Tiratoio, 1, C.F. and VAT n° IT06031960484, Business Register FI 594577, telephone number +390555359755, fax number +390550935599, email address assistenza@vino75.com. Any complaints by surface mail can be sent to Vino.com at the address above.

b) Offered products: the products offered by Vino.com are related to food, alcohol and accessories category (wines, sparkling wines, rum, grappa, other distillates and spirits). The Site is aimed exclusively at Users who have completed 18 years of age. The products can be sold either through a permanent catalog or through "flash-deal" formulas, that is promotions that provide for a availability of products subjected to quantitative and/or time limits. The sale of products takes place, unless otherwise indicated in the product sheet, by Vino.com ("Direct Selling"). Some products may be sold with drop-shipping formulas and/or by commercial partners of Vino.com ("Intermediate Selling").

c) Price of products: the total price of products, inclusive of taxes is indicated for each product in the catalog and in its relative detailed sheet; the cost of any shipment, delivery or postage costs may be fixed or variable, calculated based on the weight of the goods, the number of items selected and/or the destination address indicated by the User during the purchase process. The shipping costs can also be included in the sale price of some items or be free if the total amount of the order is higher than a certain value or in case of specific promotions. The User however is always informed about the amount of shipping costs before concluding the purchase procedure and making payment. Generally, shipping costs amount to 6,90 € for shipments throughout Italy, including islands, and are free for orders with an amount equal to or greater than 69,90 €.

d) Payment methods: Vino.com accepts the following methods of payment: credit card and prepaid cards Visa, Mastercard, Maestro, Postepay, American Express, Discover (Diners Club International and Pulse), with PayPal account, Apple Pay and bank transfer. Vino.com may, in some or all cases at its sole discretion, offer the alternative means of payment for cash on delivery. In the case of bank transfer, upon confirmation of the order, will be indicated the bank details (IBAN), the amount of the bank transfer and the order number. Payment by bank transfer will have to take place within the indicated time limits and in any case no later than 2 days from the confirmation of the order.

e) Delivery time: Vino.com, on average, is able to deliver the products purchased by Users within 24/48 working hours from receipt of the order. The expected delivery date is generally indicated on the product card, in the summary and in the confirmation of the order. Orders are generally shipped via UPS express courier or BRT. In some cases it is possible that the delivery is subject to delays due to temporary unavailability of the products at the Vino.com warehouse due in turn to delays in delivery of the goods by the producers/suppliers or the express couriers in charge of delivery to the Customer: in these cases Vino.com proposes to the Customer to wait or receive partial or complete refund of your order.

f) Complaints: Customer complaints, which can be sent to Vino.com by surface mail at the following address Via del Tiratoio, 1, 50124 FIRENZE ( FI), by e-mail to the address assistenza@vino75.com or via Fax to the number +390550935599, are managed by Vino.com according to the order of arrival, except for the most serious cases that are managed with precedence over the others. In any case, Vino.com offers maximum support to its Customers and on average responds to complaints within 24/48 working hours from their receipt.

g) Right of withdrawal: the Customer, a natural person who requests the provision of a service for purposes unrelated to his/her professional activity (’Consumer’), will have to withdraw from the purchase contract concluded with Vino.com or with the Partner without any penalties and without having to provide any reasons, within 14 working days pursuant to and for the effects of the art. 52 paragraph 1 of the Consumer Code, which start from the day of receipt of the product purchased on Vino.com. The withdrawal will be exercised by the Customer, pursuant to art. 54 paragraph 1 Consumer Code, using the withdrawal form in attachment I, part B of the Consumer Code or using the one available at the link: content/right-withdrawal or by presenting any other explicit declaration of its decision to withdraw from the contract, to be sent or by letter with return receipt, to 3ND Srl, Via del Tiratoio, 1 IT50124 Florence (FI) or by e-mail to the address assistenza@vino75.com or via Fax to +390550935599 or, in the case of Intermediate Sales, also to the e-mail address of the Partner indicated on the purchase confirmation page and also present in the User Account, putting in knowledge also Vino.com.
The letter with return receipt, the e-mail or fax must contain the indication of the product and of the order number. The burden of proof related to the correct exercise of the right of withdrawal, in accordance with the procedure indicated above, is charged to the User. Following the correct exercise of the withdrawal, unless Vino.com or the Partner does not collect the asset directly, the User will have the right to return the goods without undue delay and in any case within 14 days from the date on which the User has communicated to Vino.com or to the Partner its decision to withdraw from the contract pursuant to art. 54, c. 4. The User will need to apply, on the packaging, in a visible way the document received by Vino.com following the withdrawal notice mentioned above, in which they are already indicated the shipping address and the order details needed to identify the return to destination. We recommend the user to include a copy of this document also in the interior of the packaging, in order to avoid the loss or the impossibility to identify the return once received in the warehouse. The relative shipping costs of the goods will be charged to the User, except in the case where Vino.com has not informed the same in respect of the deed of the conclusion of the contract.
The assets must in any case be kept, handled and inspected with normal care and returned intact, complete in all their parts, accompanied by all the accessories and leaflets, identification tags and original labels, if any, still attached to the goods and intact and not tampered with, as well as perfectly suitable for their intended use and free of signs of wear and filth.
As foreseen by the art. 57 paragraph 2 of the Consumer Code, the User is responsible for any decrease in value resulting from manipulation of the good different from that necessary to establish the nature, characteristics and functioning of the asset itself. In this case Vino.com, upon written communication to be sent to the User within 5 working days from receipt of the goods, can reduce the amount of the reimbursement because of this decrease in value, providing it, in the event that the repayment is already been paid, the bank details for the payment of the amount due from the User due to the decrease in value of the property.
Vino.com can refuse to accept a withdrawal for food products that have even been partially consumed. Pursuant to the art. 59 of the aforementioned Consumer Code are excluded from the possibility of withdrawal the goods tailored or customized or that, by their nature, they can not be returned or are subject to rapid alteration or deterioration.

h) Exceptions to the right of withdrawal: the right of withdrawal can not be exercised by the User after the complete supply of the products by Vino.com if the supply itself has started with the express agreement of the User and he has accepted to lose the right of withdrawal following the full execution of the service by Vino.com. In any case, pursuant to the art. 59 of the Consumer Code, are excluded from the possibility of the recess the goods made to measure or personalized or which, by their nature, can not be returned or are subject to rapid alteration or deterioration.

i) After-sales assistance: the after-sales assistance service is provided free of charge by emailing assistenza@vino75.com or by calling +390555359755 from Monday on Fridays except holidays from 9 a.m. to 1 p.m. and from 3 p.m. to 6 p.m. Italian time (Assistance Service - Helpdesk offered by Italy from Vino.com (3ND Srl) with national geographic number to base rate (the cost of the call depends on the telephone operator used). On the site there is also a real-time assistance chat that can have a variable coverage based on the availability of the staff assigned to the assistance.

j) Duration of the general terms and conditions: The General Conditions of Contract govern the relationship between Vino.com and the User, regardless of the specific product purchased. The General Conditions of Contract for each individual purchase last until the purchase is not completed correctly, while they are open-ended in the case of purchases by formula "in subscription ".

k) Legal guarantee of conformity: Vino.com operates diligently and in absolute good faith in selecting suppliers and partners, verifying the actual suitability of the same to supply the products in the quantities and according to the characteristics described in the purchase offers, it being understood that Vino.com can not be responsible for damage to persons resulting from any violation by the manufacturers. In any case, Vino.com will not be able to ensure completeness nor of the content of the information provided by the Supplier or by the Partner nor of the perfect correspondence of what is described in the product sheet or offer with the product actually delivered, as well as the legitimacy of the use by the Supplier or Partner of images, videos and distinctive signs. The User is aware also that the images used on the proposals can sometimes only be indicative of the product and not always, faithfully represent the product delivered. In the case of Intermediate Sales, and therefore of products supplied directly by a Partner, these will be the sole responsible for compliance of the products under warranty. Any complaints must be sent directly to the Partner by e-mail to the address contained in the confirmation of purchase and for information also to assistenza@vino75.com. Partner will provide to indicate the verification methods, repair or replacement of the goods, or to authorize Vino.com to issue a refund in favor of the User. In the case of Direct Sales, Vino.com will be directly responsible for compliance of the products under warranty. In case of products that are not compliant, the User can contact Vino.com by sending an email to: assistenza@vino75.com. Vino.com will provide in such cases to indicate a repair center suitable for the verification and repair of the goods under warranty or to arrange for the withdrawal of the product and the subsequent repair or replacement or to proceed with the reimbursement of the original title used for payment or the issue of a coupon of an amount equal to the amount of the product purchased. In any case, the legal guarantee is reserved for consumers or those who have made a purchase on Vino.com for purposes unrelated to the entrepreneurial, commercial, artisanal or professional activity carried out.

l) Deposits or other financial guarantees: generally no deposits or other financial guarantees are required from the Client. If arises the need to proceed with such requests, it will be care of Vino.com to promptly inform the User with notices on the Site and by email.

m) Safety: Vino.com is attentive to privacy and data security and adopts an SSL certificate with the highest degree of protection available today for web browsing and extended to all pages of the Site (Certified 128/256-bit Extended Validation SSL released by Symantec/DigiCert): in this way your personal data are always encrypted. You can check the authenticity of the certificate of protection of Vino.com and its titularity by clicking on the appropriate protection section of the browser in use, usually next to the address bar, on the page title or on the status bar.
In addition, the payment information such as credit card data does not transit and are not processed/stored by Vino.com because processed and/or stored directly from the banking circuit. Vino.com uses professional payment services Braintree, a company of the PayPal Inc. group, which provide the consumer with maximum protection and confidentiality.
